Note: The DMCA Takedown process was not created by Clips4Sale, however as a website allowing content to be uploaded by studio owners the process is in place to protect the copyrights of the legal content owner. Clips4Sale does not determine who the legal owner of any content is when it's being disputed by a DMCA, only the courts can make those determinations. Clips4Sale can not provide any legal advice or advise any party involved in a DMCA on the course of action they should take. Once a DMCA has been completed - the issue, as far as Clips4Sale is concerned - is over once we close the case tickets.
DMCA Takedown Process
Originator (the person disputing clips posted on a Clips4Sale store) goes to our DMCA page (https://clips4sale.com/clips/page/dmca) and they fill out and complete the DMCA Takedown Request Form (https://clips4sale.com/clips/page/dmcatakedownrequest).
Clips4Sale Legal Department is assigned the case via a ticket created and verifies it is properly completed before staff begins to act on the takedown request.
Access to the Store Admin of the account in dispute is blocked (log-in is disabled) to ensure the content in dispute is preserved.
Staff will then remove and store the content in dispute (content is not deleted from the servers, it is stored and preserved per the DMCA procedure).
Once the disputed content has been removed from the store, staff will then send out two emails to the studio owner (to the email on file for the account) regarding the DMCA which lists the content that has been removed and stored.
Staff will unblock the Store Admin access and close the case (pending any further action).
IMPORTANT - If a studio is found to repeatedly post content that is disputed via multiple DMCA's then it may be closed and the store owner may be banned from using our services again in the future.
